Vigilia has obtained a mandate from an influencer to initiate proceedings under the EU’s Out-of-court Dispute Settlement (ODS) mechanism concerning 12 posts on TikTok affected by hashtag moderation.

The case relates to the platform’s practice of removing or restricting hashtags it considers in breach of its Community Guidelines. The mandate covers posts where such moderation appears to have affected the visibility and presentation of the content.

The proceedings will examine whether TikTok’s implementation of hashtag moderation complies with relevant obligations under the Digital Services Act (DSA), including requirements related to user notification, statements of reasons, and access to redress mechanisms.
